Section 5(a)(1) of the Occupational Safety and Health Act of 1970:
The employer did not furnish employment and a place of employment
which were free from recognized hazards that were causing or likely
to cause death or serious physical harm to employees in that
employees were exposed to potential hoist failure:
(a)Shop Area:  The Rotary TwoPlunger automotive hoists were
not inspected and maintained in accordance with American
National Standards Institute/Automotive Lift Institute
Safety Code for Automotive Lifts (ANSI B153.11990):
1.The employer did not ensure that operators of
automotive lifts are instructed in the safe use and
operation of the lift using the manufacturer
provided instruction and the Automotive Lift
Institute publications, "Lifting It Right," SM891
and Safety Tips," ST90.  See section 7.2.2.
2.The hoists were not inspected on a periodic  basis
as recommended by the manufacturer.  See section
7.3.
3.The locking latches on the hoists were not kept
free and oiled which prevented them from latching
into a holding position.  See section 4.1.11,
4.1.12 and E4.1.12 and the Maintenance Instructions
provided by Rotary Lift.
Among other methods, some feasible and acceptable abatement method
to correct this hazards is:
1.Contract with a qualified person to conduct
periodic inspections of the hoists.
2.Train an employee or employees to conduct frequent
inspections of the hoists.
3.Ensure employees are instructed in the safe use and
operation of the lifts using the manufacturer's
instruction and "Lifting It Right" and "Safety
Tips" supplied with the lift.
4.Display the operating instruction and "Lifting It
Right" and "Safety Tips" supplied with lift in a
conspicuous location in the lift area convenient to
the operators.
