Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to potential hoist failure: (a) Welding Fabrication Shop: On or about October 25, 1993, and at times prior thereto, the underslung hoists were not inspected and maintained in accordance with American National Standards Institute Safety Code for Overhead Hoists (Underhung)(ANSI B30.16b-1990) NOTE: See appropriate note below: 1. The hoists were not inspected on a frequent basis (at least monthly) by a designated competent person covering the items listed in section 16-2.1.2. See section 16-2.1.1(b)(1). 2. The hoists were not inspected on a periodic basis (at least annually) by a designated competent person covering the items listed in section 16-2.1.3. See section 16-2.2.1(b)(2). 3. Hooks were not inspected for defects as required by ASME/ANSI B30.10. Hooks where modified with safety latches welded on to the tips. See section 162.1.2(c)(5). %% 4. The Robins and Myers 1/2 ton hoist (multiple part wire rope) had the wire ropes twisted. See section 16-3.1.2(e). 5. The 1/2 ton CM Lodestar hoist was periodically lifting loads which were not centered under the hoist. See section 16-3.2(g). 6. The 1/2 ton CM Lodestar hoist was periodically lifting weights in excess of the rated load. See section 16-3.1.2(h). Among other methods, one feasible and acceptable abatement method to correct this hazards is: 1. Contract with a qualified person to load test and conduct periodic inspections of the hoists. 2. Train an employee or employees to conduct frequent inspections of the hoists. 3. Replace hooks with appropriate safety latches. 4. Replace wire rope so that load block and hook will not twist the multiple parts of wire rope. 5. Train employees not to hoist or lower loads off center of the hoist. 6. Ensure employees do not lift loads in excess of the hoist's rated capacity.
