Section 5(a)(1) of the Occupational Safety and Health Act of 1970: the
employer did not furnish
employment and a place of employment which were free from recognized
hazards that were
causing or likely to cause death or serious physical harm to employees in
that employees were
exposed to crushing injuries while operating the Ruffinatti TZ40 Pulling
Machine.
Jolly Rancher; Lollipop Process: On or about September 26, 2000 and times
prior thereto,
employees operating the Ruffinatti pulling machine TZ40, serial #092, were
inadequately trained
and the on-the-job instruction provided to operators was deficient, thus
exposing employees to
crushing injuries.  The training received did not ensure the use of proper
operating procedures
and/or the use of safety devices.  Training did not include the
recognition and avoidance of the
hazards associated with the rotating and moving parts.
Among other methods, one feasible and acceptable abatement method to
correct this hazard is
to develop and train employees on the utilization of standard operating
procedures (SOPs) for
machines/pieces of equipment used in the candy production. SOPs could
include regular
inspections to ensure guards and safety devices are in place, operational
and utilized.
