Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The
employer did not
furnish employment and a place of employment which were free from
recognized hazards
that were causing or likely to cause death or serious physical harm to
employees in that
employees were exposed to crushing and amputation hazards when tightening
brake wheels
on railroad cars.
A) On or about July 14, 2004 and at times prior, Employees working as MEOs
(Material
Equipment Operators) unloading railroad cars on the Spiegel Trestle, stood
on the rail to
tighten the brake wheel, while the railroad car was still in motion. This
condition exposed
employees to crushing and amputation hazards.
Among other methods, one feasible and acceptable method to correct this
hazard would be
the development, implementation, and enforcement of written safety rules
and operating
procedures for MEOs that specifically address the recognition, avoidance
and
prevention of
the unsafe working conditions of manually moving railroad cars.
