Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish to each of his employees employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to crushing and amputation hazards: A) On or about July 12, 2006 and at times prior, employees moving railcars were not adequately trained regarding the hazards of releasing and engaging the manual brake system and thus were exposed to crushing and amputation hazards. Among other methods, one feasible and acceptable method to correct this hazard would be to develop, implement, and enforce written safety rules and operating procedures for employees that specifically address the recognition, avoidance and prevention of the unsafe working conditions involving the movement of railroad cars. Abatement Note: Abatement certification and documentation is required for this item (see enclosed "Sample Abatement-Certification Letter").
