Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that: Location:1000 North Street; White Plains, New York 10605 New Road off Mc Guiness Lane On or about 3/4/98: a) Employee was exposed to the hazards of being crushed or struck by the moving equipment and the loading/unloading of materials while working within the zone of the moving Catepillar backhoe-loader model 416B, Serial # 5HK46679h961090. The backhoe was used to transport 7ft-9ft tall pine trees, which weighed approximately 200 lbs., from a trailer flatbed truck to the planting area. AMONG OTHER METHODS ONE FEASIBLE AND ACCEPTABLE ABATEMENT METHOD TO CORRECT THIS HAZARD IS TO IMPLEMENT THE FOLLOWING: a) assure the work area is clear of all personnel prior to the loading/unloading of materials and prior to the movement of equipment. NOTE: Because abatement of this violation is already documented in the inspection case file, the employer need not submit certification or documentation of abatement of this violation as normally required by 29 CFR 1903.19.
