Section 5(a)(1) of the Occupational Safety and Health Act of 1970:
The employer did not furnish employment and a place of employment which
were free from recognized hazards that were causing or were likely to
cause death or serious physical harm to employees, in that:
(a)  There was no fall protection for employees working
on top of containers, rigging the container to the
crane, exposing employees to the hazard of falling
from an elevation of approximately 20 feet to the
concrete surface below.  Among other methods, one
feasible method of abatement would be using equipment
designed to lift intermodal containers which do not
require employees to be on top of the containers to
rig the crane to the container.

(a)  Safe access and/or egress was not provided for
employees accessing and egressing the container
tops as evidenced by employees climbing up the
containers by wedging their feet in the channels
of the containers sidewalls and by employees
riding the cranes sling when accessing and
egressing
the container tops, exposing employees to the
hazard of falling an elevation of approximately 20
feet to the concrete below.  Among other methods,
one feasible abatement includes providing and
requiring use of portable ladders to access and
egress the container tops.
