Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that: a) Atomizer Dept., employees were exposed to the hazard of oxygen deficient atmospheres (O.D.A.), resulting from inadequate confined space entry procedures, at the furnace melt chamber, cooling chamber, cyclones and clean room. The procedures were inadequate for the following reasons: 1) There were no adequate written confined space entry (C.S.E.) procedures available. 2) Employees and supervisors were not trained in safe C.S.E. procedures. 3) C.S.E. procedures did not include the use of a permit system, with management "sign-off" (authorization) and hazard/control checklist. 4) C.S.E. procedures did not include adequate provisions for testing of oxygen and 1,1,1 trichloroethane levels. Oxygen meters available, were improperly calibrated. 5) There were no provisions for medical surveillance of personnel performing C.S.E. work. 6) Warning labels and safety industrical signs, were not posted in the area of C.S.E. work. 7) Preparation for C.S.E. work did not include provisions to assure that ventilation was adequate, or that work practices were proper. 8) There was not always a standby worker available, with proper rescue equipment, during C.S.E. work, and his function was not properly understood. 9) C.S.E. work was performed without use of a lifeline and harness, or equivalent provisions in all cases. 10) Self contained breathing apparatus was not always immediately available, at the site of C.S.E. for rescue. 11) Preparation for C.S.E. did not always include a check to assure that proper safety equipment, such as air line respirators, lifelines etc., were being used.
