Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees who were entering or leaving the building were subject to being struck by material that could fall from the building or from the overhead tower crane: a) Two Independence Place, Phila., PA, 8/10/85 A feasible and useful mean of abatement would be to install a scaffold type structure with 2-inch planking that would be used to provide over- head protection.
