Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees who were entering or leaving the building were subject to being struck by materials that could fall from the building for from the overhead tower crane: a) Two Independence Place, 8/10/85 A feasible useful means of abatement would be to install a scaffolding type structure with 2-inch planking that would be used to provide overhead protection.

Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The %% employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were being carried over the heads of employees by a tower crane: a) 7th FloorDeck and all Decks where flying forms were being used, 8/16/85 A feasible and useful means of abatement would be to establish specific walkways for employees and if a load was carried over the walkways a signal person could signal any employees in the walkway to clear the area.
