Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to being struck by moving traffic: On the jobsite: a)The method of signaling by the flagger did not conform to Part VI of the Manual on Uniform Traffic Control Devices. The flagger was not using sign paddles while directing traffic. b)The employer did not train the employee in the recognition of workzone hazards. One feasible method of abatement is to use the proper signs when directing traffic and train employees to recognize the hazards of workzone safety.e
