Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to being struck by vehicular traffic: a)An employee was directing traffic without the use of paddles or signs. b)An employee was directing traffic without a traffic vest. c)Training was not provided to the employee in the recognition of unsafe conditions in work zone safety. Among other methods, recognized and feasible means of abatement to correct this hazard is to: a) Ensure that employees who direct traffic are provided with suitable paddles or flags and traffic vests; and, b) Comply with the applicable elements required by the Manual on Uniform Traffic Control Devices (Millennium Edition), June 2001 when performing work that affects highway and street traffic.
