Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to being struck by vehicular traffic: a)An employee was setting out traffic signs in the roadway without wearing a traffic vest. b)Training was not provided to the employees in the recognition of unsafe conditions in work zone safety. Among other methods, recognized and feasible mans of abatement to correct this hazard is to: a) Ensure that employees who set out traffic signs are provided with suitable traffic vests and provided with training that enables them to recognize and control hazards associated with vehicles; and, b) Comply with the applicable elements required by the Manual on Uniform Traffic Control Devices (Millennium Edition), June 2001 when performing work that affects highway and street traffic.
