Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to being struck by vehicular traffic: At the jobsite - The employee was not wearing a vest where there was an exposure to moving traffic. Among other methods, recognized and feasible means of abatement to correct this hazard is to: a) Ensure that employees are provided with suitable traffic vest; b) Comply with the applicable elements required by the Manual of Uniform Traffic Control Devices (Millennium Edition), June 2001 when performing work that affects highway and street traffic.
