Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to fall hazards: a.On the telecommunication tower, fall protection was not used when ascending the telecommunication tower to 140 feet. OR IN THE ALTERNATIVE: 29 CFR 1926.105(a): Safety nets were not provided when workplaces were more than 25 feet above the ground or water surface, or other surface(s) where the use of ladders, scaffolds, catch platforms, temporary floors, safety lines or safety belts was impractical: a.On the telecommunication tower, fall protection was not used when ascending the tower to 140 feet. Among the feasible means of abatement that could be used to correct this condition are: a. Enforce the use of fall protection when employees ascend or descend the communication towers. b. Utilize approved crane baskets with the use of cranes in accordance with 29 CFR 1926.550(g).
