Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The
employer did not furnish employment and a place of employment which were
free
from recognized hazards that were causing or likely to cause death or
serious
physical harm to employees in that employees were exposed to the hazard of
falling from the work platform used on a Crown high lift order picker rider
truck when the work platform was in a raised position.
Among other methods, one feasible and acceptable abatement method to
correct
this hazard is to provide a platform meeting the requirements of Paragraph
7.34, American National Standard for Powered Industrial Trucks, Part III,
ANSI
B56.1-1988.  These requirements include:
(a) a slip resistant surface;
(b) a restraining means in place; such as rails, chains, cable, etc. or, in
the alternative, a means for securing person(s) on the platform;
(c) a 4 inch minimum height toe plate; and,
(d) sufficient space to accommodate the personnel and equipment being
elevated.

INCH
STANDARD HEIGHT AND LACKED AN INTERMEDIATE RAIL HALF WAY BETWEEN THE TOP
RAIL
AND THE PLATFORM FLOOR.
