Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to being struck by material if the "A" frame structured used
to hoist material was
overloaded and failed.
A) LOCATION: THROUGHOUT SHOP
LIFTING "A" FRAMES USED TO HOLD ELECTRIC HOISTS, WERE NOT RATED TO
INDICATE THEIR MAXIMUM INTENDED LOADS.
B) LOCATION: OVER THE SMALL BUNCHER NEAR THE PRODUCTION OFFICE
AND OVER THE DOUBLE TWIST MACHINE.
THE "A" FRAME STRUCTURES HAD BEEN ALTERED WITHOUT ANY
SUPPORTING ENGINEERING DOCUMENTATION TO INDICATE THE NEW RATED
LOAD FOR THE FRAMES. THE ALTERED DESIGN PLACED THE MAIN RAIL OF THE
FRAME UNDERNEATH THE END SUPPORTS, PLACING THE ENTIRE LOAD ON THE
BOLTS THAT SUSPENDED THE RAIL. IN ADDITION, THE ALTERED DESIGN
ELIMINATED ANY TYPE OF RAIL STOPS AND ALLOWED THE HOIST TROLLEY TO
BE PULLED OFF THE RAIL AT EITHER END.
