Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that: employees were exposed to the hazards of falling down the hoistway shaft when the elevator car was not in the landing zone, being struck by the elevator car when the car was entering or leaving the landing zone, or having part of their body caught between the moving elevator and the hoistway. A feasible and useful method to correct this hazard, among other methods, is to provide the elevator hoistway or the landing with doors or gates to prevent employees from having any part of their body within the hoistway shaft, outside the periphery of the landing, unless the elevator is within the landing zone. The doors or gates must be electrically interlocked so as to prevent the elevator car from moving when the hoistway or the doors/gates are in the open position and must be so latched that they cannot be opened from the landing side unless the elevator car is within the landing. a). Freight Elevator: The gates at both elevator landings, first and second floors, had sufficiently large openings between their wooden slats which allowed entry of the worker's hand to operate controls, or accidental entry of a worker's foot, etc.. In addition the openings at the top of both gates were very large. These conditions created a hazard in that a worker's leg or arm could get caught between the moving elevator and the hoistway or gate structures and be crushed. b). Freight Elevator: The gates at both elevator landings, first and second floors, could be opened at any point during the elevator's operation. These conditions create a hazard in that a worker could fall down an open shaftway or a worker could be struck by the moving elevator and be crushed.
