Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employmnent and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to blood and other potentially infectious materials. (a)Location: Establishment The employer had identified job classifications in the Exposure Management Plan that had a potential occupation exposure to bloodborne pathogens. The job classification of "helper" or "picker" on rear-loading residential routes had been identified in this group. Outsourced or temporary laborers were typically retained for this work. The oursourced or temporary workers had not been trained in the Waste Management of Central Massachusetts Exposure Management Plan for bloodborne pathogens. Among other methods, a feasible and acceptable abatement method could include: Provide the listed employees with training in accordance with 1910.1030(g)(2).
