Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to an unsafe hoisting mechanism: BATTERY CHARGING AREA: EMPLOYEES WERE EXPOSED TO THE HAZARD OF THE HOISTING CHAIN FAILING DURING A LIFT WHICH COULD CAUSE A FORKLIFT BATTERY TO FALL. ONE FEASIBLE AND ACCEPTABLE METHOD TO CORRECT THIS HAZARD, AMONG OTHERS, IS TO FOLLOW ESTABLISHED GUIDELINES SUCH AS THOSE PROVIDED BY THE HOIST MANUFACTURER AND ANSI B30.16, WHICH INCLUDE THE FOLLOWING SPECIFIC REQUIREMENTS: 1.PERFORM FREQUENT AND PERIODIC INSPECTIONS OF HOISTING EQUIPMENT. FREQUENT INSPECTIONS SHOULD BE CONDUCTED DAILY TO WEEKLY AND PERIODIC INSPECTIONS SHOULD BE PERFORMED AT INTERVALS DETERMINED BY THE CONDITIONS OF SERVICE, BUT SHOULD NOT EXCEED ONE YEAR INTERVALS. 2.ADEQUATELY TRAIN ALL OPERATORS AND MAINTENANCE PERSONNEL REGARDING THE HOISTING EQUIPMENT. EMPLOYEES COULD THEN PERFORM FREQUENT EQUIPMENT INSPECTIONS INSTEAD OF RELYING ON PERIODIC INSPECTIONS TO UNCOVER ANY DAMAGE OR DEFECTS THAT COULD COMPROMISE THE SAFETY OF THE EQUIPMENT.
