Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: fall hazard at the ten and twenty foot levels when unloading equipment off the platform of an equipment elevator lift. (a)Plant - Employees operate a 135 ton Di-Acro press brakes, Serial Number JJ1199, and a Di-Acro 30 ton with no serial number available, with no means provided to protect the foot pedal from unintended activation by someone accidently stepping on it from the sides. (b)Plant - Employees operate a thirty (30) ton Di-Acro press brake that does not have the foot pedal protected to prevent unintended activation by falling or moving objects or someone accidently stepping on it. AMONG OTHER METHODS, ONE FEASIBLE AND ACCEPTABLE ABATEMENT METHOD TO CORRECT THIS HAZARD IS TO INSTALL A FOOT PEDAL/TREADLE GUARD. VERIFICATION REQUIRED
