Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were not wearing a seat belt while operating powered industrial trucks and were exposed to the hazard of being thrown from the operators station: (a)Con-way Freight, Incorporated, 425 Church Road, York, Pennsylvania - Employee(s) were observed operating forklifts to load and unload van trailers from an elevated dock area without wearing the restraint device (seat belt). The employer did not require employees to wear seat belts while operating the powered industrial trucks, on or about September 2, 2008. ABATEMENT NOTE: Among other methods, one feasible and acceptable abatement method to correct this hazards is to wear the seat belts provided on the powered industrial trucks. VERIFICATION REQUIREDTION
