Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to a potential crushing injury from falling roof assemblies and/or catwalks resulting from deficient hoists. (a)Final Finish Catwalk Number 2 - The hoist chain was worn beyond safe operation and the motor brake disc and spline were worn, or about May 9, 2006. (b)B Half Floors - The beam capacity was not marked and/or legible from floor level; the hoist chain was worn beyond safe operation; the push button station was damaged and the cord insulation was torn, on or about May 9, 2006. (c)Above Catwalk Number 4 - There were no end stops for the hoist motors and the beam capacity was not marked and/or legible from floor level, on or about May 9, 2006. (d)B Roof - There were multiple hoists operating on the hoist beam and there were no stops to prevent one hoist from striking another and the push button station had a broken housing, on or about May 6, 2006. (e)Shingle Buggy - The hoist chain was worn beyond safe operation and the shunt on the hoist brake was broken, on or about May 9, 2006. AMONG OTHER METHODS, ONE FEASIBLE AND ACCEPTABLE ABATEMENT METHOD TO CORRECT THESE HAZARDS WOULD BE TO ENSURE THAT THE HOISTS MEET THE REQUIREMENTS OF "ANSI B30.16, OVERHEAD HOISTS", AND THAT DEFECTS ARE REPAIRED AS SOON AS POSSIBLE.

Section 5(a)1 of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which was free from recognized hazards that were likely to cause serious physical harm to employees in that the employees responsible for performing work installing plumbing and other electrical equipment on the tops of the units were exposed to a slip and fall hazard. This slip/fall hazard involves the risk of slipping off of the joists or rafters and falling onto the top of the unit. Such work should be performed within a controlled access zone by trained employees, and employees performing such work should wear appropriate footwear.
