Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to crushing and amputation from unintended activation: (a)Fabrication Department - The two (2) foot treadles on a mechanical Wysong press brake, where the employee feeds material by hand and removes material by hand, were not guarded to prevent accidental operation, on or about April 4, 2002. (b)Fabrication Department - The foot treadle on a Niagara mechanical press brake, number 1b- 65-8-10, was not guarded to prevent accidental operation, on or about April 4, 2002.
