Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employmnent and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: (a) On or about November 5, 2007, on Saltsman Road in Erie, PA; an employee was being lowered into an approximately six and one-half foot deep excavation by the bucket of the backhoe. AMONG OTHER METHODS, ONE FEASIBLE AND ACCEPTABLE METHOD TO CORRECT THIS HAZARD WOULD BE TO FOLLOW THE INSTRUCTIONS IN THE "HYDRAULIC EXCAVATOR" SAFETY MANUAL ISSUED BY EMI (EQUIPMENT MANFUCTURERS INSTITUTE) WHICH STATES ON PAGE 20-WORK SAFELY "NEVER USE A BUCKET FOR A WORK PLATFORM OR PERSONNEL CARRIER".
