The alleged violations below have been grouped because they involve similar or related hazards that may increase the potential for injury resulting from an accident. Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: Roof Top : The hazard of improper installation and use of a Garlock Hand Powered Hoist, in that the company did not inspect the hoist before every use, the company did not use permanent counterweights (they used roofing materials), and they did not tie the hoist frame to an integral member of the building structure, creating fall and/or flying object hazards. Amoung other methods, one feasible and acceptable method to correct this hazard is to use and follow the manufacturer's specifications and operations instruction manual to inspect the hoist before every use, to use permanent counterweights, and to tie the frame off to an integral member of the building structure.
