Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards
that were causing or likely to cause death or serious physical harm to
employees in that
employees were exposed to:
(a)  On or about July 10, 1995, and at times prior to that date, employees
engaged in
the installation of patio deck railings at 3101 34th Avenue SW were
exposed to a
potential fall hazard of approximately 15 feet created by the unsecured
work platform
on the Loadall #530B forklift, serial #530B-4AL/581014, as referenced by
ANSI
B56.6-1987 5.15.1 (b) which states, "Whenever a rough terrain forklift
truck is used
to elevate personnel, the following precautions for the protection of
personnel shall be
taken:  Be certain that the platform is securely attached to the lifting
carriage or
forks."
Among other methods, one feasible and acceptable abatement method to
correct this
hazard is to ensure that the work platform is securely fastened to the
lifting carriage
by the use of a chain or to the forks by the use of pins.

potential fall hazard of approximately 15 feet created by inadequate
operator training
for the operator of the Loadall #530B forklift, serial #530B-4AL/581014, as
referenced by ANSI B56.6-1987 5.16.1 which states, "Only trained and
authorized
operators shall be permitted to operate a rough terrain forklift truck.
Operators
of
rough terrain forklift trucks shall be qualified as to visual, auditory,
physical, and
mental ability to operate the equipment safely according to paragraph 5.17
and all
other applicable parts of section 5."
Among other methods, one feasible and acceptable abatement method to
correct this
hazard is to ensure that all forklift operators receive training and
certification to
operate forklifts as specified by paragraph 5.17 and all other applicable
parts of
section 5, ANSI B56.6-1987.
