Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: (a) Employees were exposed to a potential fall hazard while working on top of covered hopper cars at the elevator car loading areas due to the lack of fall protection. Among other methods, one feasible and acceptable method to correct this hazard would be to install some type of fall protection. (b) Employees were exposed to a fall hazard while operating the manlifts in the two units due to the lack of a car enclosure on each manlift. Among other methods, one feasible and acceptable method to correct this hazard would be to install a car enclosure on each manlift.
