Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: (a) Employees were exposed to a potential fall hazard while operating the manlift due to the lack of adequate guardrails. Among other methods, one feasible and acceptable method to correct this hazard would be to install a midrail on the car enclosure. (b) Employees were exposed to a crushing hazard while working near the manlift due to the lack of an enclosure around the base of the manlift. Among other methods, one feasible and acceptable method to correct this hazard would be to install a guardrail system with a gate around the base of the manlift.
