Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: (a) For employees riding the manually operated manlift in the west elevator and exposed to a potential fall hazard of approximately 25 feet created by the lack of a car enclosure on the manually operated manlift. (b) For employees riding the manually operated manlift in the west elevator and exposed to a potential fall hazard of approximately 25 feet created by the damaged and frayed pull rope. Among other methods, feasible and acceptable methods to correct these hazards would be to install a car enclosure gate on the manlift and install a new pull rope.
