Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees: (a) Employees were exposed to a potential fall hazard while working on the roof-top equipment located on areas of the roof that were deteriorated and not capable of supporting the weight of the employees. Feasible and acceptable abatement methods to eliminate the hazard include, but are not limited to: Repair or replace the areas of the deteriorated roof where employees are required to perform duties; or Install a structurally sound walking/working surface with standard railings on the roof where employees are required to perform duties; or Install a complete personal fall arrest system, which maintains a safety factor of at least two, on the roof where employees are required to perform duties.
