Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees: (a) Employees were exposed to a potential fall hazard while working on top of covered rail hopper cars due to the lack of fall protection. Among other methods to correct this hazard would be to install some type of fall protection (safety harness with a lanyard, guardrails or an equivalent means of protection).

Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees: (a) Employees were exposed to a potential hazard of a rollover or impact hazards while pulling rail hopper cars with a tractor/payloader and the use of a nylon tow rope. Among other methods, one feasible and acceptable method to correct this hazard would be to change the method of moving railcars by pushing rather than pulling or by the use of a secondary chain connected to front end of the tractor and to the railcar to totally secure the movement of the railcar.
