Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees: (a) At the north side of the elevator, employees were exposed to a potential fall hazard while working on top of hopper cars due to the lack of any type of fall protection. Among other methods, one feasible and acceptable method to correct this hazard would be to install some type of fall protection (safety belts and body harness, guardrails or an equivalent means of protection).
