Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees: (a) At the north side of the elevator, employees were exposed to a potential hazard of rollover and impact hazards while pulling covered hopper railcars with the Michigan payloader and the use of a nylon tow rope. Among other methods, one feasible and acceptable abatement method to correct this hazard would be to change the method of moving railcars by pushing rather than pulling or by the use of a secondary chain connected to the front of the loader and to the railcar to properly secure the railcar.
