Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: (a) Employees were exposed to a potential fall hazard while working on top of covered hopper railcars during loading operations. Among other methods, one feasible and acceptable method to correct this hazard would be to install some type of fall protection. Abatement Note: Abatement certification is required for this item (see enclosed "Sample Abatement Certification Letter").tion

Among other methods, one feasible and acceptable method to correct this hazard would be to replace the gate or to install guardrails on the manlift car.
