Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to:
(a) On or about 02/06/98 for two employees attempting to unload three
pallets of shingles
from a scissor type elevating stake-bed truck and exposed to a potential
crushing hazard
created by the unsecured load.  ANSI A92.7-1981 Section 13.1, item (4)
requires that
loads or cargo be properly restrained prior to being driven or elevated.
Among others, one feasible and acceptable method to abate this hazard
would be to ensure all
loads or cargo are properly secured and/or restrained prior to the vehicle
being driven or the
truck bed being elevated.

created by the trucks outriggers not being utilized to stabilize the truck
frame. ANSI
A92.7-1981 Section 13.2, item (4) requires that the outriggers or
stabilizers be used if
the manufacturer's instruction requires their use.
Among others, one feasible and acceptable method to abate this hazard
would be to ensure that
the truck's outriggers are used each time the truck bed is elevated to
ensure the truck frame is
stabilized.

crushing hazard created by the lack of guardrails on the truck bed.  ANSI
A92.7-1981
Section 13.2, item (5) requires that movable guardrails and doors are in
place or closed,
or both, unless their location requires that they be opened or moved for
normal operation
of the unit.
Among others, one feasible and acceptable method to abate this hazard
would be to ensure the
guardrails are installed on the truck prior to the truck being driven or
elevated to reduce or
eliminate the potential for an unsecured load to slide off the truck bed.

were exposed to:
(a) On or about 02/06/98 for employees attempting to unload three pallets
of shingles
from a scissor type elevating stake-bed truck and exposed to a maximum
potential fall
hazard of approximately 14 feet created by the lack of standard fall
protection. ANSI
A92.7-1981 Section 13.2.4 requires that personnel shall maintain a firm
footing on the
platform while working thereon.  Where required, harness/lanyard devices
fixed to
manufacturer's approved attachment points shall be used.
Among others, one feasible and acceptable method to abate this hazard
would be to ensure any
and all employees working on the elevated truck bed at heights greater
than 6 feet are provided
and required to use standard fall protection devices.
