Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: (a) Employees were exposed to a potential fall hazard while working on top of railcars during loading operations at the main elevator and the north elevator. Among other methods, one feasible and acceptable method to correct this hazard would be to install a fall arrest system (safety belts and lanyards) or an equivalent means of protection. (b) Employees were exposed to a potential fall hazard while climbing to the top of the east storage bins/tanks to position the incline auger, open and close the lids, and to sample grain from the top of the bins. Among other methods, one feasible and acceptable method to correct this hazard would be install a guardrail system or an anchorage point on each bin to attach a restraint or fall arrest system.
