Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to crushing injuries during powdered metal press operation, maintenance and set up due to a lack of original and continuing competence of personnel who maintain, inspect and/or service the presses and a lack of thorough periodic and regular inspections of the powdered metal presses to assure all parts, auxillary equipment and safe guards attached meet established safety requirements: (a) Sizing and molding departments; powdered metal presses without safeguards or devices, barrier guard with openings that are too large and die setters using unsafe methods of die-setting. Among other methods, feasible and acceptable abatement methods include: 1. Training of personnel servicing, inspecting and maintaining powdered metal presses on an initial and continuing basis to assure competence and familiarity with the industry safety requirements for powdered metal presses, such as established by the Powdered Metals Industries Federation Standard No. 47 and the American National Standards Institute B11.6 2. A program of periodic and regular inspections of powdered metal presses for compliance to safety requirements with certifications which include date of inspection, signature of person performing the inspection, and serial number or other identifier of the press inspected.

Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to crushing injuries from failure of a brake on a powdered metal press during feeding or removing parts from presses while they were guarded at the point of operation by a two hand control, presence sensing device, type B gte, or movable barrier guard: (a) Sizing department; the Gasbarre Sizing Press equipped with a two hand control device. Among other methods, feasible and accetable abatement methods include: 1. Installation of a brake monitor system with an approved control system designed, constructed and arranged to monitor the effectiveness of the powdered metal press braking system or: 2. Installation of point of operation devices, such as pull back restraints.
