Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment or a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees. Employees were exposed to the hazard of being struck by the drophammer. At the establishment - Drophammer operator stepped on foot treadle that was positioned above a floor hole causing the operator's front/treadle foot to be lower than the stationary/back foot exposing the employee to the hazard of tripping and being projected and struck by the hammer. Among other methods, one feasible and acceptable method to correct this hazard is to affix a cover to the floor hole or treadle mechanism that prevents the treadle/front foot from being lower than the back foot.
