Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to:
(a.) The hazard of falling down the hoistway shaft from the second or
third floor landings.  The
freight elevator gates could be opened without the elevator car in
position at the landing,  and
(b.)  The hazard of being struck by the elevator car and having a portion
of ones body caught
between the moving elevator car and the frame of the hoistway opening.
The freight elevator
controls on the third floor allowed the elevator car to be sent to another
floor without the gates
being fully closed.
A feasible method to correct these hazards would be to repair the
interlocks on the gate
latch mechanisms so that their pins have to be physically engaged in the
female portion of the
latches at all of the gates at each landing in order for the elevator car
to
be called or sent to
another landing. (4/25/2000).
