Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of falling: (a) Location - Jobsite, 177 Old Main St., Tewksbury, MA: On or about 10/27/99, employees were exposed to a serious fall of 15 feet while raised on the forks of the Shaunessey material lift, serial no. 96565 without the use of a safety platform. Among other methods, feasible and acceptable to correct these hazards include, but are not limited to the following: a. Obtain the manufacturer's approval to use the equipment for the lifting of personnel with a fully guardrailed platform attached to the forks of the lifting carriage and with personnel wearing the appropriate fall protection. b. Use another method to lift personnel such as a scaffold or scissors lift.
