Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of being crushed or struck: (a) Location - Establishment: On or about 9/28/99, employees were exposed to the hazard of being crushed or struck while the Komatsu Front End Loader was operating in reverse. Among other methods, feasible and acceptable to correct this hazard include but are not limited to: (a) Assure that the back up alarm is in operating condition. (b) Utilize a spotter while operating in reverse.
