Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of falling: (a) Location - Walgreens, Rte. 38, Tewksbury, MA: On or about 8/12/99, employees were exposed to a serious fall hazard of 12 feet while climbing over the guard rails of the Shaugnessy Scissors Lift, Serial #36680 onto a makeshift platform attached to the scissors lift. Among other methods, feasible and acceptable to correct this hazard include but are not limited to: a) Read and follow operators manual guidelines for safe use of the scissors lift. b) Utilize the gate provided within the guard rail system of the scissor lift.
