Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to falls from work platforms elevated by powered industrial trucks: (a) Location - Business Interiors Warehouse: On or about 12/01/00, an employee was elevated on an unsecured wooden pallet with guardrails using a powered industrial truck. Among other means, one feasible means of abatement would be to: 1. Comply with all of the requirements of ANSI/ASME B56.1-1993, Safety Standard for Low Lift and High Lift Trucks, Sections 4.17 Elevating Personnel and 7,35 Platforms - Elevating, which include, but are not limited to: a) providing a restraining system such as a guardrail or means for securing personnel such as a body belt and lanyard and where guardrails with entry gates or chains are provided, ensure that they are capable of withstanding a concentrated horizontal force of 200 lbs.; and b) providing a means to securely attach the platform to the lifting carriage or forks and to prevent the lifting carriage or forks from pivoting upward; and c) providing the weight of the platform, load capacity and the capacity of the truck needed to lift the platform with a determined load in a prominent location on the platform.
