Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of: (a) Location - Jobsite, 600 River Street, Haverhill, MA: On or about 12/10/02, employees were exposed to a fall hazard of 20 feet while climbing over the guard rails of the Shaughnessy Scissors Lift, serial no. 32461, onto the sign band of the exterior of the building. Among other methods feasible and acceptable to correct this hazard includes, but not limited to: a. Read and follow the manufacturer's operations manual guidelines for safe use of the scissors lift. b. Ensure that the gate provided within the guardrail system is utilized.
