Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to a fall hazard created by rotted decking: (a) Location - Workplace Fishing Pier: On or about 9/25/00, rotted deck boards on the pier exposed employees to a fall hazard. Among other methods, feasible means of abatement methods include: (1) To replace all rotted deck boards on the pier. (2) To develop an inspection and maintenance program designed to identify weakness in the system, in order to prevent a structure failure.
