Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to being struck by falling material while passing beneath a load of cement block elevated to a height of 16 feet by a Hyster 50 forklift truck which had been left unattended by the operator: (a) Location - Jobsite, new addition: On or about 12/17/98, employees were exposed to falling materials while the Hyster 50 forklift truck was left unattended with a load of cement block, raised to a height of 16 feet. Among other methods, feasible and acceptable methods to correct this hazard include, but are not limited to: 1. Lower the load to ground level when leaving the forktruck unattended. 2. Training the operators on the requirements of ANSI B56.6-1969 safety standard for powered industrial trucks.
