Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to broken bones, crush injuries and possible death: In the following instances the employer did not require employees to wear seat belts while operating forklifts in snow and ice which may result in forklift accidents. a)Production Area - Two employees were not wearing seat belt while operating a forklifts. One possible means of abatement, among others, would be to require seat belt use.
