Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to fall hazards: (a) Employee(s) were exposed to a fall hazard while retrieving materials from overhead racks approximately 10-15 feet from ground level while standing on the forks of an industrial truck when it was located near the north wall of the building. Among other methods, one feasible and acceptable abatement method to correct this hazard is to use the safety platform at the establishment, secured to the lifting carriage and/or forks equipped with a standard railing at a verticle height of 42 inches as recommended by ANSI B56.1-1988. In addition, an operator must remain at the controls while personnel are working on the plat- form.
