Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to injury from fall hazards: A) Employees working on the second and third shifts were climbing stacks of bundled, unassembled, cardboard boxes to retrieve/obtain boxes at the top of the stacks in the box warehouse thus exposing employees to falls of approximately six to fifteen feet to the concrete floor below. Among other methods, one feasible and acceptable abatement method to correct this hazard is to retrieve/obtain the cardboard boxes by a powered industrial truck (forklift) as referenced in ANSI B56.1-1969.
